Mr. Juarbe Jiménez, a capital member of the Marichal Hernández LLC, is an experienced trial and appellate lawyer whose practice includes complex commercial litigation, construction, banking, insurance, administrative, and contract law, serving both private and public clients. Juarbe has represented Puerto Rico’s largest banks and construction companies across a range of issues. In his more than 26 years of experience, he has earned a reputation as a problem-solver and an aggressive advocate, combining his significant trial experience with his appellate skill to represent clients in complex disputes at all stages of litigation.

Juarbe served as a law clerk for Justice Negrón García of the Puerto Rico Supreme Court. Before joining Marichal Hernández, Juarbe co-founded a law firm representing clients in diverse areas, including construction, banking, insurance, environmental law, and government contracts. He is known for his successful representation of clients in complex, high-stakes disputes in both state and federal courts, and has extensive experience representing clients in government-facing litigations and investigations, as well as complex land use and zoning issues. Juarbe practices in the areas of complex business litigation and arbitration, including handling multiple business disputes, corporate management issues, class actions, banking and lender liability, construction litigation, professional malpractice, breach of contract, personal injury, real estate, and shareholder disputes.

  • Class Action Defense (Consumer Law): Successfully represented an international hotel chain against a consumer class action (2021).
  • Lender’s Liability: Successfully represented a bank against dozens of homeowners whose residences were damaged after a landslide.
  • Construction Defect Defense: Successfully defended a homebuilder in construction defect litigation concerning faulty foundation and weatherproofing (2009).
  • Permits/Zoning Approval Defense: Successfully defended a homebuilder in litigation in which several neighboring property owners opposed the construction of a residential-tourist development alleging fraud in the permit process (2022).
  • Lender’s Liability: Successfully represented the lender in action filed by a borrower claiming violation of the Truth in Lending and RICO Acts. The court rejected the borrower’s claims and returned a judgment in favor of the bank (2022).
  • Insurance Litigation: In a claim for damage suffered during a hurricane to various public buildings in which the insurer denied insurance coverage citing various policy exclusions, the parties reached a settlement of six figures in favor of the municipality (2023).
  • Non-compete/Non-solicitation Litigation: Represented a former executive in a lawsuit brought by their employer alleging breach of non-compete and non-solicitation agreements, as well as trade secret violations; established unenforceability of restrictions in contracts and obtained a verdict and judgment in favor of former employees (2021).
  • Juarbe is an ally and pro-bono legal consultant for the True Self Foundation, a nonprofit organization that supports LGBTQ+ communities in Puerto Rico.
